While businesses are most concerned about meeting FCC regulations, healthcare systems sending to US citizens or mobile numbers should also be aware of HIPAA regulations.<\/p>\n\n\n\n<p>The United States&#8217; Health Insurance Portability and Accountability Act (HIPAA) states that a patient\u2019s <em>protected health information<\/em> (PHI) must stay protected by healthcare providers and covered entities who utilise electronic communications such as SMS.<\/p>\n\n\n\n<p>If HIPAA compliance is not followed, your business or practice could face substantial penalties. According to the HIPAA journal, a single breach could cost up to <a href=\"https:\/\/www.hipaaguide.net\/hipaa-rules-regarding-text-messaging\/\" target=\"_blank\" rel=\"noreferrer noopener\">$50,000 USD<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is SMS texting HIPAA compliant?<\/h2>\n\n\n\n<p>Because patient information, including personal identifiers, requires additional protection and security measures to ensure privacy, SMS is <em>not always<\/em> HIPAA-compliant. According to the HIPAA security rule, encryption is a crucial requirement for the transit of electronic communications between patients and providers.&nbsp;<\/p>\n\n\n\n<p>It is up to healthcare providers and practices to ensure their messaging content complies with HIPAA rules.<\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#ebedee\"><strong>Top tip:<\/strong> encryption means data gets concealed by converting it into a code<\/p>\n\n\n\n<p>SMS technology did not initially get built for messages to get sent with encryption. This means that other users may gain unauthorised access to sensitive information, such as PHI, through illegal or accidental means.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Best practice tips to send secure HIPAA SMS.<\/h2>\n\n\n\n<p>In 2013, HIPAA enacted a <a href=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/privacy\/laws-regulations\/combined-regulation-text\/omnibus-hipaa-rulemaking\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">final omnibus ruling<\/a> stating that as long as healthcare providers adhered to three specific conditions, they could send PHI over unencrypted emails. In 2018, the Director of the HIPAA enforcement agency Roger Severino came out to say he believes the <a href=\"https:\/\/www.healthcareittoday.com\/2018\/03\/06\/texting-patients-is-ok-under-hipaa-as-long-as-you\/\" target=\"_blank\" rel=\"noreferrer noopener\">same rules should apply to text messaging<\/a> and other forms of communication.<\/p>\n\n\n\n<p>To send and receive PHI communications to patients over unencrypted channels, the provider must:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Inform the patient of the encryption risk<\/li>\n\n\n\n<li>Gain authorisation that the patient is willing to accept the risk<\/li>\n\n\n\n<li>Document the patient\u2019s consent<\/li>\n<\/ol>\n\n\n\n<p>Additionally, we also recommend healthcare providers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Acquire and document consent for all communications<\/li>\n\n\n\n<li>Check and maintain correct phone records by requiring 2FA (2-factor authentication) when first onboarding<\/li>\n\n\n\n<li>&nbsp;Send SMS reminders to patients to update their contact details regularly<\/li>\n\n\n\n<li>Always include the option for patients to opt-out of receiving SMS<\/li>\n\n\n\n<li>Make communications single purpose (i.e. do not combine appointment reminders and marketing in the same message)<\/li>\n\n\n\n<li>Educate and train all healthcare staff on the proper use and misuse of SMS messaging (as well as what constitutes a HIPAA violation)<\/li>\n<\/ul>\n\n\n\n<p>Keep in mind, if healthcare communications do not contain PHI, HIPAA rules do not apply.<\/p>\n\n\n\n<p class=\"has-background\" style=\"background-color:#ebedee\"><strong>Note:<\/strong> This article is not legal advice.
